Ms. Marcus is an experienced New York attorney who has litigated a wide variety of insurance issues in the state and federal courts of New York. Ms. Marcus has been with the firm since 1983 and offers a broad perspective on the legal landscape impacting property and casualty insurers. Ms. Marcus routinely litigates subrogation issues, such as dispositive motions challenging the scope of liability and recoverable damages under New York law.
Ms. Marcus is well-versed in litigating insurance-related matters outside of subrogation. Ms. Marcus successfully litigated a broker's duty to procure replacement insurance for a defendant based on the agent's knowledge of the defendant's business practice. Ms. Marcus successfully pursued a liability carrier and broker to recover on a consent judgement of over $5MM, resulting in a substantial recovery despite overwhelming evidence of misrepresentation by the defendant liability insured. Ms. Marcus also successfully defended an insurer in a first party coverage action brought by a policyholder whereby the court declared the policy void ab initio due to fraud and misrepresentation of the insured, with the agent also being required to indemnify the insurer for all legal fees. In addition to litigating cases, Ms. Marcus also handles the day-to-day management of the firm.
Ms. Marcus is admitted in the courts of the State of New York, and the United States District Courts for the Southern, Eastern and Northern Districts of New York. Ms. Marcus attended Syracuse University (B.A. 1979) and New York Law School (J.D. 1982). Ms. Marcus is a member of the New York State Bar Association and the American Bar Association.
