Mr. Smith has been with the firm since 1988 and has over 35 years experience pursuing subrogation and defending first and third-party claims for insurers, self-insurers and third-party administrators. Mr. Smith has tried numerous subrogation cases to verdict and has also tried to verdict other insurance-related cases, including defending insureds in personal injury and property damage claims and defending insurers against first-party property coverage disputes. Mr. Smith has extensive experience with alternative dispute resolution, including binding arbitrations. Mr. Smith has participated in more than one hundred mediations, the vast majority of which have resulted in settlements. Mr. Smith's experience includes pursuing recoveries of all sizes, including achieving multiple multi-million dollar recoveries on behalf of subrogating insurers.
Mr. Smith has been involved in a number of high-profile subrogation matters. He served as a steering committee member on the Con Edison Steam Explosion Litigation which involved taking more than one hundred depositions and the review of hundreds of thousands of documents. Mr. Smith has also served as liaison counsel on a number of high profile subrogation litigation matters such as the East 91st Street Crane Collapse Litigation and the East 51st Street Crane Collapse Litigation. Mr. Smith has also delivered numerous training seminars on subrogation issues for insurance claim professionals.
Mr. Smith is admitted in the courts of the State of New York and New Jersey, the United States District Courts for the Southern, Eastern, and Northern Districts of New York, and the United States District Court for the State of New Jersey. Mr. Smith attended Brooklyn College (B.A. cum laude 1978) and SUNY at Buffalo School of Law (J.D. 1981). Mr. Smith is a member of the New York State Bar Association and American Bar Association.
